Speaking in the Rajya Sabha on Monday, home minister Amit Shah announced on Monday that Article 370 which grants special status to the state of Jammu and Kashmir will be scrapped.

The home minister also announced the bifurcation of the state in two union territories. J&K to be a union territory with legislature. Ladakh will also be a UT without a legislature.

The home minister announced that Jammu and Kashmir will no longer be a state and it will be bifurcated in two parts — J&K and Ladakh.

Jammu and Kashmir will be a union territory with a legislature.

Ladakh will a union territory without a legislature.

Earlier in the day, the Union Cabinet headed by PM Narendra Modi met in New Delhi amidst speculation that the government may take some decisions on Jammu and Kashmir. Union home minister Amit Shah and law minister Ravi Shankar Prasad were the first to reach the prime minister's residence, where the meeting is taking place.

Former chief ministers Omar Abdullah and Mehbooba Mufti were not be allowed to move out of their respective house in view of the restrictions, while Congress leader Usman Majid and CPM MLA MY Tarigami claimed to have been arrested around midnight.

The government on Monday imposed restrictions under section 144 Code of Criminal Procedure (CrPC) in Srinagar district with effect from midnight, which shall remain in force till further orders. On Monday morning, Section 144CrPC was also imposed in Jammu region.

The authorities imposed night curfew in Kishtwar and Rajouri districts and Banihal area of Ramban district. The authorities also imposed curfew and restrictions in Rajouri district from Sunday night and ordered the closure of all educational institutes.

Mobile Internet services have been suspended in the Kashmir Valley and satellite phones were provided to police officials and district magistrates.

The Narendra Modi government has decided to revoke the Article 370, which grants special autonomous status to Jammu and Kashmir, moving ahead with its plan to fundamentally change J&K’s relation to India despite its potential to cause massive unrest in the region.

The BJP has been opposing the special status for Jammu & Kashmir for a long time. It had earlier claimed that it could not repeal Article 370 during Atal Bihari Vajpayee government due to lack of majority. The BJP has been opposing it since Jan Sangh days

Dealing with Article 370 in the chapter on Jammu and Kashmir, the BJP manifesto in 2014 said "the BJP reiterates its stand on the Constitution provision and will discuss this with all stakeholders and remains committed to the abrogation of this article”. The return of Kashmiri Pandits to the land of their ancestors with full dignity, security and assured livelihood will figure high on the BJP's agenda, it added.

WHAT IS ARTICLE 370?

This Article specifies that except for Defence, Foreign Affairs, Communications and ancillary matters (matters specified in the Instrument of Accession), the Indian Parliament needs the state government's concurrence for applying all other laws. Thus, the state's residents lived under a separate set of laws, including those related to citizenship, ownership of property, and fundamental rights, as compared to other Indians.
Similar protections for unique status exist in tribal areas of India, including those in Himachal Pradesh, Arunachal Pradesh, Andaman & Nicobar Islands and Nagaland. However, it is only in the case of Jammu and Kashmir that the accession of the state to India is still a matter of dispute between India and Pakistan, still on the agenda of the UN Security Council and where the Government of India vide 1974 Indira-Sheikh accord committed itself to keeping the relationship between the Union and Jammu and Kashmir within the ambit of this Article.

WHY IT WAS INCORPORATED

Dr. Amitabh Mattoo, former Vice Chancellor of Jammu University, in an article for The Hindu explained it thus:

"First, why was Article 370 inserted in the Constitution? Or as the great poet and thinker, Maulana Hasrat Mohani, asked in the Constituent Assembly on October 17, 1949: "Why this discrimination please?" The answer was given by Nehru's confidant; the wise but misunderstood Thanjavur Brahmin, Gopalaswami Ayyangar (Minister without portfolio in the first Union Cabinet, a former Diwan to Maharajah Hari Singh of Jammu and Kashmir, and the principal drafter of Article 370). Ayyangar argued that for a variety of reasons, Kashmir, unlike other princely states, was not yet ripe for integration. India had been at war with Pakistan over Jammu and Kashmir and while there was a ceasefire, the conditions were still "unusual and abnormal”. Part of the State's territory was in the hands of "rebels and enemies”.

In fact, today the autonomy enjoyed by the State is a shadow of its former self, and there is virtually no institution of the Republic of India that does not include J&K within its scope and jurisdiction. The only substantial differences from many other States relate to permanent residents and their rights; the non-applicability of Emergency provisions on the grounds of "internal disturbance" without the concurrence of the State; and the name and boundaries of the State, which cannot be altered without the consent of its legislature. Remember J&K is not unique; there are special provisions for several States which are listed in Article 371 and Articles 371-A to 371-I.

Jammu and Kashmir BJP president Ravinder Raina Sunday said his party is for early abrogation of Articles 370 and 35A of the Constitution.

He also exhorted confidence that the BJP will form the next government in the state on its own.

Raina said his party will work for defreezing of the eight assembly seats reserved for refugees from Pakistan-occupied Kashmir (PoK) and revoking of the cumbersome M-Form exercise for Kashmiri migrant pandits before the next assembly polls.

"Article 370, a temporary transititional provision, is the biggest injustice with the people of Jammu and Kashmir, while the Article 35A is a constitutional blunder which was included through back door without the consent of Parliament and the president...We wish the early abrogation of both these constitutional provisions," Raina told reporters here.

Article 370 grants special status to Jammu and Kashmir and limits Parliament's power to make laws concerning the state. Article 35A empowers the state assembly to define 'permanent residents' for bestowing special rights and privileges on them.

On Friday, National Conference president Farooq Abdullah had said Prime Minister Narendra Modi cannot remove Article 35A and Article 370 of the Constitution.

"Let him be as powerful as he (Modi) likes, he cannot remove Article 370 and Article 35A (from the state of Jammu and Kashmir)," Abdullah had said, adding "our right of Article 370 and Article 35-A should be protected. This is very important for us. We are soldiers of this country, not enemies".

Accusing Kashmir-based politicians of "misleading" the people of the state on these articles, Raina said Article 370 is a "wall of hatred" and the main reason for the prevailing situation in the Jammu and Kashmir.

"Both the provisions have to go. Article 35A is discriminatory in nature as Omar Abdullah (former chief minister) if marries outside the state, his wife is entitled to various rights under these articles but when her sister Sara married Sachin pilot, she lost all her rights over property in the state," he said.

When his attention was drawn towards the BJP dominating only in 28 assembly seats in the just concluded parliamentary elections and the possibility of coalition with any other party, he said, "I am hopeful that the BJP will get the clear mandate like Prime Minister Narendra Modi who returned to power with a landslide victory."

Teachers working with Key Stage pupils might, for instance, focus on the subject content of science and develop science skills from these areas of experience. This product centred approach could, for example, give rise to oral explanations and demonstrations of scientific knowledge, and, from time to time, practical activities designed to provide direct experience of phenomena with opportunities to explore and investigate these phenomena. In providing a conceptual structure to help the learner build a functional mental representation, the teacher highlights what is relevant and the nature of the relationships between the elements. For example, the teacher might explain the compressibility of air in a bicycle pump by describing it as dispersed particles which may be brought closer or else by comparing it with the behaviour of a spring.

In contrast, teachers might focus on the processes of science and develop scientific conceptual understanding from it. This process-centred approach could, for instance, offer the children experiments and investigations as starting points for acquiring conceptual knowledge with little or no direct teaching of concepts. In this case a conceptual structure is withheld. The onus is on the children to recall or construct a functional mental representation without reference to a teachers’ description of one. Pupils might infer relationships in the topic under study and may be given an opportunity to test and revise their ideas.

Of course, other teachers might focus on a combination of these two approaches and develop scientific skills and conceptual understanding from in this combination. This mixed approach could be a balance or, perhaps, a compromise, between a product-centred and a process-centred approach, in which the teacher provides a partial conceptual structure and leaves the remainder for children to construct by inferring, hypothesising, or testing their ideas. It could encourage lessons where children do investigations with some features already identified by the teacher, and with some conceptual knowledge about the subject that enables them to appreciate the purpose of the activity. In contrast, it could encourage lessons without a clear purpose which mixed different types of activity, but did not develop either conceptual or procedure understanding exclusively.

As per a notice available on the GSEB official website, the board will release the GSEB result for the Science stream students at 8 am. However, based on past year trends, it is highly likely that the board will release the result before 8 am.
